GIN BURCHFIELD CHRISTIAN LEADERSHIP PROGRAMS AGREEMENT
1. Parties
This Christian Leadership Programs Agreement ("Agreement") is entered into on the Effective Date by and between Gin Burchfield, PCC, NBCHWC, doing business as Gin Burchfield Coaching ("Coach," "we," "us," or "our"), whose principal office is in Wake County, North Carolina, and Participant ("Participant," "you," or "your"). Coach and Participant may each be referred to as a "Party" and collectively as the "Parties."
2. Program
You are enrolling in the Christian Leadership program, experience, intensive, retreat, or other offering identified at the time of purchase or registration ("Program").
Your specific Program may include group coaching, facilitated discussion, reflection, Christian faith-based conversation and practices, somatic or body-based awareness practices, educational content, guest speakers, exercises, resources, experiential activities, and opportunities for connection with other participants.
The specific dates, duration, location, format, inclusions, and payment terms for your Program are those described on the applicable registration, enrollment, or purchase page and are incorporated into this Agreement by reference.
3. Purpose & Philosophy
Gin Burchfield Coaching's Christian Leadership programs are designed to create meaningful spaces for women to explore faith, responsibility, leadership, discernment, capacity, relationships, stewardship, and personal growth.
These experiences are grounded in the belief that meaningful leadership is not simply about becoming capable of carrying more. It also requires discernment about what we are called to carry, awareness of how responsibility affects our bodies and relationships, and thoughtful stewardship of our gifts, influence, energy, and capacity.
The Program may explicitly incorporate Christian faith, prayer, Scripture, spiritual reflection, and discussion of God, calling, discernment, and stewardship. By enrolling, you understand and agree that Christian faith is an intentional part of the Program rather than incidental content.
Participation does not require you to hold any particular theological position beyond any eligibility requirements stated for the specific Program. Participants are encouraged to engage thoughtfully and respectfully with one another, recognizing that individual beliefs, traditions, interpretations, and experiences may differ.
4. Nature of Coaching & Educational Experiences
Coaching is a thought-provoking and creative process intended to support personal and professional awareness, growth, and development. You remain the expert on your own life and are responsible for determining what insights, practices, suggestions, or information are appropriate for you.
The Program is not psychotherapy, counseling, pastoral counseling, medical treatment, legal advice, financial advice, or spiritual direction and should not be used as a substitute for professional services when those services are needed.
Although Christian faith and spiritual themes may be explored, Coach and any guest speakers or facilitators are not acting as your pastor, clergy member, therapist, physician, attorney, financial advisor, or other licensed professional unless expressly stated otherwise.
You understand and agree that you are solely responsible for your decisions, actions, participation, and results.
5. Somatic & Experiential Practices
Some Programs may include optional somatic, mindfulness, breathing, movement, grounding, reflection, or other experiential practices designed to increase awareness of the relationship between the body, emotions, thoughts, leadership, and lived experience.
You are responsible for deciding whether and how to participate in any practice. You are encouraged to honor your own physical and emotional needs, modify or decline any activity that does not feel appropriate, and seek medical or mental health guidance when needed.
Participation in a Program does not create a medical, therapeutic, or mental health treatment relationship.
6. Participant Responsibilities
You agree to:

Participate in the Program with honesty, curiosity, respect, and consideration for other participants.

Take responsibility for your own choices, boundaries, well-being, and level of participation.

Respect differences in personal experience, Christian tradition, perspective, leadership context, and belief.

Maintain the confidentiality and privacy of other participants as described in Section 8.

Refrain from recording, photographing, screenshotting, distributing, or publicly sharing another participant's personal comments, experiences, image, or identifying information without that person's express permission.

Communicate directly with Coach if a concern arises regarding your participation or the Program environment.

Remit payment according to the terms selected at enrollment.

Conduct yourself in a manner that supports a respectful, safe, and constructive group environment.
Coach reserves the right to remove a participant whose conduct is disruptive, threatening, discriminatory, repeatedly disrespectful, violates another participant's confidentiality, or otherwise materially interferes with the integrity or safety of the Program. Removal for violation of these expectations does not relieve Participant of any outstanding financial obligation except as otherwise required by law.
7. Fees & Payment
The Program fee and available payment options are those stated at the time of enrollment.
By enrolling, you authorize the payment method selected at checkout and agree to make all payments according to the schedule associated with your purchase.
If you select a payment plan, you understand that the payment plan is a method of paying the total Program fee and is not a month-to-month subscription unless expressly stated otherwise.
Enrollment constitutes a financial commitment to the Program you purchased. Failure to attend, participate, or make use of Program resources does not cancel scheduled payments or create a right to a refund except as expressly provided by the cancellation or refund terms for the applicable Program.
If a scheduled payment is declined, you agree to promptly provide a valid payment method. Gin Burchfield Coaching may suspend access to Program meetings, materials, resources, or other benefits while an account remains delinquent.
8. Confidentiality & Group Privacy
Gin Burchfield Coaching recognizes that meaningful group experiences depend upon trust. Coach will treat personal information shared during the Program as confidential, subject to applicable law, professional ethical obligations, and the exceptions described below.
Because the Program involves interaction with other participants, Gin Burchfield Coaching cannot guarantee that another participant will maintain confidentiality. Each participant therefore agrees to protect the privacy of the group.
You may share your own insights, experiences, and learning outside the Program. You may not share another participant's story, comments, circumstances, identity, personal information, or experiences without that participant's express permission.
Confidential information may be disclosed by Coach when: (a) you consent to its release; (b) disclosure is required by law, court order, subpoena, mandatory reporting requirement, or applicable professional duty; (c) Coach reasonably believes disclosure is necessary because of imminent risk of serious harm; (d) the information becomes public through no fault of Coach; or (e) disclosure is made to Coach's legal, financial, technical, or professional advisors who are subject to appropriate confidentiality obligations.
Testimonials, photographs, recordings, or identifying participant stories will be used for marketing purposes only with appropriate permission.
9. Attendance, Cancellations & Program Changes
Group Programs are offered on specific dates and times and depend upon the participation of the group as a whole. Missed group meetings, events, intensives, retreat sessions, or other scheduled Program activities are generally not rescheduled, made up individually, credited, or refunded because of a Participant's absence.
If recordings, materials, alternative participation options, or other accommodations are offered for a particular Program, those will be provided at Coach's discretion or as stated in the Program description.
If Gin Burchfield Coaching must cancel or reschedule a Program meeting or activity, reasonable efforts will be made to provide an alternative date, replacement experience, credit, or other appropriate remedy.
Program schedules, locations, speakers, topics, activities, and other details may occasionally change because of circumstances outside Coach's reasonable control or because Coach determines that an adjustment better serves the Program and its participants. Such reasonable changes do not constitute cancellation of the Program or create an automatic right to a refund.
10. Guest Speakers & Outside Professionals
Certain Programs may include guest speakers, facilitators, practitioners, or other outside professionals.
Unless expressly stated otherwise, these individuals are independent from Gin Burchfield Coaching and are responsible for their own statements, services, recommendations, products, and professional conduct.
A guest's participation in the Program does not constitute Gin Burchfield Coaching's endorsement or guarantee of any separate product, service, program, advice, or professional relationship offered by that guest.
Any decision to purchase services or enter into a separate relationship with a guest speaker or another participant is solely your decision and is outside the scope of this Agreement.
11. Intellectual Property & Program Materials
All Program materials created or provided by Gin Burchfield Coaching, including worksheets, exercises, frameworks, presentations, recordings, written materials, graphics, prompts, and other resources, are owned by Gin Burchfield Coaching or used with permission and are provided for your personal use only.
You may not reproduce, distribute, sell, publish, teach, modify for commercial use, or otherwise share Program materials without prior written permission.
Nothing in this section prevents you from applying what you personally learn through the Program in your own life, work, relationships, or leadership.
Materials belonging to guest speakers or other third parties remain the intellectual property of their respective owners.
12. Refunds & Withdrawal
Unless a different refund or cancellation policy is expressly stated for the Program at the time of purchase, Program fees are non-refundable once enrollment is completed.
Choosing not to attend, discontinuing participation, experiencing scheduling conflicts, or otherwise withdrawing from the Program does not eliminate your responsibility for the full Program fee or any remaining payments under an agreed payment plan.
If Gin Burchfield Coaching cancels an entire Program and does not provide a substantially equivalent replacement, participants will receive an appropriate refund or credit for the portion of the Program that was not delivered.
Any Program-specific written guarantee or refund policy provided at enrollment supersedes this section to the extent that its terms differ.
13. Program Term
This Agreement begins on the Effective Date and continues through completion of the Program and fulfillment of all payment obligations.
If the Program is offered over multiple months, your enrollment is for the full stated Program term unless the applicable enrollment terms expressly provide otherwise.
Coach may suspend or discontinue a Participant's participation for material breach of this Agreement, violation of group confidentiality, inappropriate conduct, or delinquent payment. Unless otherwise required by law or expressly agreed in writing, suspension or removal for Participant breach does not eliminate any outstanding payment obligation.
Sections concerning confidentiality, intellectual property, payment obligations, limitation of liability, dispute resolution, and other provisions that by their nature should survive will remain effective after completion or termination of the Program.
14. Results & Personal Responsibility
Every participant enters the Program with different experiences, circumstances, goals, relationships, faith journeys, and leadership responsibilities.
Gin Burchfield Coaching does not guarantee any specific personal, professional, relational, spiritual, health, financial, or business outcome as a result of participation.
Your experience and results depend upon many factors, including your own participation, choices, circumstances, and application of what you learn.
15. Limitation of Liability & Indemnification
To the fullest extent permitted by law, Coach's liability arising from this Agreement or the Program shall not exceed the total fees actually paid by Participant for the applicable Program.
In no event shall Coach be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in the Program.
Participant agrees to indemnify and hold harmless Gin Burchfield Coaching from claims arising from Participant's own actions, decisions, conduct, or unauthorized use or disclosure of Program materials or another participant's confidential information, to the extent permitted by law.
16. Governing Law & Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict-of-laws rules.
The Parties agree to first attempt to resolve any dispute through good-faith discussion. If the dispute cannot be resolved informally, the Parties agree to attempt mediation in Wake County, North Carolina before initiating litigation, except where immediate legal or equitable relief is reasonably necessary.
17. Entire Agreement & Program-Specific Terms
This Agreement, together with the applicable Program description, registration or purchase terms, and any written Program-specific addendum, constitutes the entire understanding between the Parties regarding participation in the Program and supersedes prior discussions or representations concerning the same subject.
If a Program-specific written term conflicts with this Agreement, the Program-specific term will control for that Program.
Any amendment to this Agreement must be made in writing.
18. Severability
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
19. Acknowledgment & Acceptance
By signing this Agreement or electronically accepting it during enrollment, you acknowledge that you have read and understood its terms, had the opportunity to ask questions before enrolling, and voluntarily agree to participate under these terms.
You also acknowledge that the Program is an explicitly Christian, coaching-based and educational experience and is not therapy, medical treatment, pastoral counseling, legal advice, financial advice, or a substitute for professional care.
